These Terms of Service ("Terms") govern your access to and use of the website at academy.zapthru.com and your enrolment in any ZapThru Academy educational programme. By accessing our website or enrolling in a programme, you agree to be bound by these Terms. Please read them carefully.
"ZapThru Academy," "we," "us," and "our" refer to the operating entity behind academy.zapthru.com. "You" and "your" refer to the individual accessing our website or enrolled in a programme.
You may use our website for lawful purposes related to evaluating or using our educational services. You agree not to: use our website in any way that violates applicable laws or regulations; attempt to gain unauthorised access to any part of our systems; copy, reproduce, or distribute our website content without written permission; or use the website to transmit spam, malware, or harmful content.
We reserve the right to suspend or terminate access to any user who violates these Terms or uses our website in a harmful or abusive manner.
You must be at least 18 years of age to enrol in any ZapThru Academy programme. By submitting an application, you confirm that you meet this requirement. We reserve the right to decline any application or withdraw an enrolment offer at our discretion.
You agree to provide accurate and complete information during the application and enrolment process. Providing false or misleading information — including misrepresenting your qualifications or background — may result in termination of your enrolment without refund.
Programme curriculum, schedules, and content are subject to change. We will provide reasonable advance notice of material changes affecting enrolled students. Minor adjustments to content, session formats, or scheduling do not constitute a material change.
The Human Excellence Programme involves sessions with trained practitioners using evidence-based modalities including NLP, Gestalt Therapy, Metaphors of Movement, IEMT, Quantum Creativity, Mental Space Psychology, and Emotional Intelligence development. These sessions are for performance development purposes and do not constitute clinical therapy, medical treatment, or psychological counselling. If you have a diagnosed mental health condition, we recommend consulting your healthcare provider before participating.
You agree to engage honestly with your practitioner and to disclose any conditions that might be relevant to the work. The effectiveness of these sessions depends significantly on your willingness to engage. We cannot guarantee specific outcomes from the Human Excellence Programme.
Where your programme includes participation in an industrial project with a partner company, you agree to: maintain appropriate confidentiality regarding any proprietary information you access; behave professionally in all interactions with partner company personnel; meet agreed project deadlines and quality standards; and comply with any additional terms set out by the partner company for the specific project.
Intellectual property created during industrial projects is governed by the specific agreement between ZapThru Academy and the partner company. You will be informed of IP terms before beginning any project.
Programme fees are as communicated in your enrolment documentation. Payment terms, instalment arrangements (where offered), and any discounts are set out in your individual enrolment agreement. All fees are stated inclusive of applicable taxes unless otherwise specified.
Failure to meet payment obligations may result in suspension of access to programme materials and sessions until the account is brought current. Persistent non-payment may result in termination of enrolment. For our refund terms, see the separate Refund Policy.
All content on our website and within our programme materials — including text, videos, templates, frameworks, and curriculum — is owned by or licensed to ZapThru Academy. You may use programme materials for your own personal learning purposes only. You may not reproduce, distribute, sell, modify, or create derivative works from our materials without our prior written consent.
Student work — projects, analyses, and assignments you produce during the programme — remains your intellectual property, except where it relates to proprietary data or systems of a partner company, in which case the project IP terms apply.
ZapThru Academy completion certificates and industrial experience certificates are issued upon satisfaction of programme requirements. These documents accurately represent what you achieved — they are not guarantees of employment or professional licensure. Misrepresenting these credentials (such as claiming a certificate for incomplete work) is a violation of these Terms and may result in certificate revocation.
You agree to treat all ZapThru Academy staff, practitioners, Tech Leads, fellow students, and partner company personnel with respect. Behaviour that is abusive, discriminatory, harassing, or disruptive — in any programme interaction, including live sessions, group work, or communications — may result in immediate suspension or termination of your enrolment. In serious cases we may involve relevant authorities.
Some programme content, including certain curriculum frameworks and proprietary methodologies, is confidential to ZapThru Academy. You agree not to share, publish, or distribute this content externally. This obligation survives the end of your programme.
Our programmes are designed to develop skills and capabilities, but we do not guarantee specific employment outcomes, salary levels, or career results. Individual results depend on many factors outside our control, including market conditions, personal circumstances, and the effort you apply. Testimonials on our website reflect individual experiences and are not representative of outcomes for all students.
Our website and programme materials are provided "as is." We make reasonable efforts to ensure their accuracy but do not warrant that they are error-free or complete.
To the maximum extent permitted by applicable law, ZapThru Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or participation in our programmes — including lost profits, lost data, or loss of opportunity. Our total liability for direct damages arising from any claim related to our services shall not exceed the total fees paid by you for the relevant programme in the twelve months preceding the claim.
You agree to indemnify and hold harmless ZapThru Academy, its staff, practitioners, and partners from any claims, losses, or damages arising from your breach of these Terms, your violation of applicable law, or any misrepresentation you make in connection with your enrolment.
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved through good-faith negotiation in the first instance. If negotiation fails, disputes shall be submitted to binding arbitration in Los Angeles, California, under the rules of the American Arbitration Association. This clause does not prevent either party from seeking injunctive relief in a court of competent jurisdiction.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. For material changes, we will notify enrolled students by email with at least 14 days' notice. Your continued use of our services after changes become effective constitutes acceptance of the revised Terms.
